Follow the Pub Code Adjudicator’s withdrawal of advice note “Tied Rent Contractual Dispute Resolution Clauses and Calderbank Offer Letters” dated July 2017, please find the below comment from CAMRA.

CAMRA’s Chief Executive, Tom Stainer said:

“We welcome this move by the Adjudicator. At a time when the Government is reviewing the Code, this is the perfect time for all stakeholders, including the Pubs Code Adjudicator itself, to raise recognised failings in the Code and its implementation.

“The tenants involved in securing the withdrawal of previously issued guidance have fought hard (and at great personal cost) to secure this result, which reinforces what CAMRA has maintained from the early days of the Code – that Market Rent Only could and should be achieved through simple means such as a Deed of Variation.

“CAMRA has been raising detailed concerns for some time about how the Code must be improved to deliver a fair deal for hard working tenants across England and Wales. We very much hope that the review will result in substantial changes to both guidance and legislation.”
